The relevant Constitutional Act created legislative conditions for guaranteeing the state security. According to the level and nature of threat or disturbance of the state security and on the basis of conditions laid down by the Constitution of the Slovak Republic and by this constitutional act, constitutional bodies can declare war, state of war, state of emergency or state of crisis in order to solve the crisis situation. There are also defined conditions and scope of restriction of fundamental rights and liberties, as well as the extent of responsibilities at the time of state of crisis. The constitutional act lays down also the method of performance of public authority at the time of war, state of war and state of emergency. There was established Parliamentary Council of the Slovak Republic, which performs constitutional powers of the National Council of the Slovak Republic if its activity is precluded at the time of war, state of war or state of emergency. Security Council of the Slovak Republic is an advisory body in peacetime, and if the activity of the Government of the Slovak Republic is precluded at the time of war, state of war or state of emergency, the Security Council of the Slovak Republic performs its constitutional powers until the Government resumes its activity. In compliance with territorial and administrative division of the Slovak Republic, there were also established security councils of districts and areas and determined their competences and tasks.


Act No. 346/2005 Coll. on State Service of Professional Soldiers of Armed Forces of the Slovak Republic and on Change and Amendment of Some Acts

The subject of this Act is the arrangement of legal relations related to the performance of state service of professional soldiers. It defines the state service of professional soldiers, conditions of admission to the state service and types of the state service.
The Act regulates origin, changes and termination of service relationship of professional soldiers and proceedings in matters of service relationship; conditions for the performance of the state service of professional soldiers such as service time, leave, business trip and study visit, time off, care for professional soldiers, remuneration, compensation of travel cost, contribution for accommodation and for adaptation of flat at relocation, particulars of benefits in kind, and compensation of damage.

This Act regulates in self-contained manner basic relations in the area of defence of the Slovak Republic. The Act defines defence of the state and preparation for national defence. It determines tasks for the National Council of the Slovak Republic, President of the Slovak Republic, Government of the Slovak Republic, Ministry of Defence of the Slovak Republic, other ministries, other central bodies of the state administration, other bodies of the state administration with nationwide activity, regional offices and district offices, municipalities and higher territorial units in the field of national defence. Higher military administration and territorial military administrations perform state administration in the field of the national defence in the scope of competences stipulated in this Act.
The Act defines terms such as defence planning, national defence support, facilities of special importance, and other important assets for the national defence.

The Act also regulates rights and obligations of legal entities, natural persons authorised to perform business and natural persons in preparation for the national defence and in defence of the state, in particular civilian duty, the duty to provide accommodation and duty to provide designated assets; the Act also stipulates liability of such persons for violation of obligations imposed to them by this Act.

The Armed Forces of the Slovak Republic (hereinafter referred to as the “Armed Forces”) were established by this Act. The Act regulates internal organisational structure of the Armed Forces, their financing and management of the state assets used by the Armed Forces.
The Act also specifies management of the Armed Forces that is the responsibility of the Government of the Slovak Republic and the Ministry of Defence of the Slovak Republic.
The Armed Forces are under the command of the President of the Slovak Republic, Chief of the General Staff of the Armed Forces of the Slovak Republic and other appointed commanders in the scope of their competences. Command of the Armed Forces from professional, organizational and technical aspects is secured by the General Staff of the Armed Forces of the Slovak Republic.
Apart from the afore-mentioned, this Act regulates control of the Armed Forces, position of the Military Office of the President of the Slovak Republic, Guard of Honour of the President of the Slovak Republic and mobilization of the Armed Forces.
The Act specifies legal arrangement of international cooperation of the Armed Forces and sending of the Armed Forces outside the territory of the Slovak Republic for the purposes of humanitarian assistance, military training, peace observer mission, military operation, and in order to secure the fulfilment of commitment from international agreement on common defence against aggression.
The Act also lays down terms such as military weapon, military weapon system, and their use and obligations after use of military weapon or other coercive measure.

It also contains legal arrangement of procedures of the Armed Forces in securing airspace integrity, including acts of illegal invasion of the airspace of the Slovak Republic.

Act No. 570/2005 Coll. on National Service and on Change and Amendment of Some Acts

The subject of this Act is regulation of scope of national service, its origin and termination, national registration of citizens, including in and excluding from the national registration; performance of registered citizens conscription, examination of physical ability of a soldier in reserve or soldier in extraordinary service, reserves of the Armed Forces of the Slovak Republic and conscript into, discharge from and exempt from performance of extraordinary service during the state of crisis. The Act also regulates performance of military service in the armed forces of a different country and offences in the area of national service.

Act No. 569/2005 Coll. on Alternative Service at the Time of War and State of War

The Act regulates alternative service that which a registered citizen or soldier in reserve is obliged to perform in the time of war and state of war instead of extraordinary services, method of refusal to perform the extraordinary service, records of registered citizens and soldiers in reserve obliged to perform alternative service, conscription of registered citizens and soldiers in reserve obliged to perform alternative service, and performance of alternative service.

The Act regulates position, activity, tasks and organisation of the Military Police that, within the scope of the relevant Act, fulfils tasks of police protection of the Ministry of Defence of the Slovak Republic, Armed Forces of the Slovak Republic and bodies participating in fulfilment of tasks of the Armed Forces, of police protection of military buildings and premises, military material, as well as of other assets of the state administered or used by the Ministry of Defence of the Slovak Republic in premises or places where military operations or military actions take place. The Act also lays down obligations and authorities of a military policeman who may be only a professional soldier.


Act of the National Council of the Slovak Republic No. 198/1994 Coll. on Military Intelligence

The act regulates position, tasks, organization, direction and supervision of Military Intelligence. Military Intelligence is a special service within the Ministry of Defence of the Slovak Republic which fulfils tasks of defence intelligence security of the Slovak Republic in a scope of this Act. While fulfilling its mission, Military Intelligence is authorised to cooperate with authorities of similar functioning in other countries. The act also lays down responsibilities and authorities of members of the Military Intelligence.


Act No. 455/2004 Coll. on Establishment of the General Milan Rastislav Štefánik Academy of the Armed Forces, on Merger of the General Milan Rastislav Štefánik Military Airforce Academy in Košice and the University of Technology in Košice, on Establishment of the Marshal Andrej Hadik National Academy of Defence and on Change and Amendment of Some Acts

The General Milan Rastislav Štefánik Academy of the Armed Forces was established by the relevant Act as a state college; it is a military college of university type. By means of the relevant Act there was also established the Marshal Andrej Hadik National Academy of Defence as an educational and training centre that performs education and training in the form of career courses and other courses. Both academies are based in Liptovský Mikuláš, and their incomes and expenditures are connected to the state budget through the budget chapter of the Ministry of Defence of the Slovak Republic.

The relevant Act regulates establishment, change and cancellation of military districts, their administration, legal relations to real estates and stay in their territory.
Military district is a territorial unit and administration unit used for securing tasks of the national defence; it is established by the Government of the Slovak Republic by Ordinance upon proposal of the Ministry of Defence of the Slovak Republic and with an approval of relevant municipalities.


Act No. 11/2004 Coll. on Defence Standardisation, Codification and State Verification of the Quality of Products and Services Intended for Defence

The Act lays down procedures and conditions of defence standardisation, codification and state verification of the quality of products and services intended for defence; it also regulates performance of state administration and legal relations arising in connection with performance of the defence standardisation, codification and state verification of the quality of products.
The defence standardisation is a process of processing and implementation of defence concepts, doctrines, procedures, and proposals to achieve and maintain the required level of compatibility, interchangeability or conformity with defence concepts, doctrines, procedures, and proposals of the North Atlantic Treaty Organization and member states of the Organization in order to attain inter-operability in the fields of operations, procedures, material, technology and administration.
Defence Standardisation, Codification and Government Quality Assurance Authority based in Trenčín was established by the relevant Act. The Authority is a state administration body with nationwide activity in the area of defence standardisation, codification and state verification of the quality in the scope provided by the relevant Act.


Act No. 110/2004 Coll. on the Activity of the Security Council of the Slovak Republic at the Time of Peace

The Act provides details of operation of the Security Council of the Slovak Republic as the advisory body in peacetime.
The Security Council of the Slovak Republic fulfils its tasks in peaceful periods in the following areas:

- creation and realisation of the defence system of the Slovak Republic;
- meeting international commitments in the field of security;
- evaluation of security situation in the Slovak Republic and in the world;
- preparation of proposals of measures required for preserving security of the Slovak Republic.

For preparation and fulfilment of its tasks, the Security Council of the Slovak Republic sets up committees that are its standing working bodies. These are the Foreign Policy Committee, Defence Planning Committee, Civil Emergency Planning Committee, and the Intelligence Services Co-ordination Committee.

This Act concerns social security for members of Police Corps, Slovak Information Service, National Security Authority, Corps of Prison and Judicial Guard, Railway Police, customs officers and members of the Armed Forces.
The social security comprises health security, accident security, retirement security and social security services.

In the area of health security, the following is provided

  • compensation of service income of professional soldier unable to perform the state service for a disease or an injury;
  • sickness benefit;
  • compensation allowance;
  • maternity benefit.

In the area of accident security, the following is provided :

  • compensation for loss of service income;
  • compensation for suffering and for difficulties connected with asserting oneself in society;
  • compensation for reasonably spent costs connected with medical treatment;
  • one-off extraordinary compensation.

In the area of retirement security, the following is provided:

  • retirement contribution;
  • severance pay;
  • death benefit;
  • annuity retirement pension;
  • disability annuity retirement pension;
  • widow’s annuity retirement pension;
  • widower’s annuity retirement pension;
  • orphan’s annuity retirement pension.

Social security services include

  • recreation care,
  • spa treatment,
  • and arranging a funeral.

Act No. 335/2002 Coll. on Increase of Retirement Contributions and Annuity Retirement Pensions from Social Security of Soldiers in the Year 2002
This Act regulates increase of annuity retirement pensions, disability annuity retirement pensions, widow’s annuity retirement pensions, widower’s annuity retirement pensions, orphan’s annuity retirement pensions, and retirement contributions awarded before 1st July 2002, namely for 5 % of monthly amount of the relevant pension to which the beneficiary was entitled as of the date of pension increase.

Act No. 471/2003 Coll. on Increase of Retirement Contributions and Annuity Retirement Pensions from Social Security of Soldiers in the Year 2003
This Act regulates increase of annuity retirement pensions, disability annuity retirement pensions, widow’s annuity retirement pensions, widower’s annuity retirement pensions, orphan’s annuity retirement pensions and retirement contributions in the year 2003.

Act No. 463/2003 Coll. on Veterans and on Amendment of Act No. 328/2002 Coll. on Social Security for Policemen and Soldiers and on Change and Amendment of Some Act as amended
Amendments: Act no. 219/2006 Coll. (with effect from 1st july 2006)

The Act provides conditions for awarding the status of veteran and activity of the Ministry of Defence of the Slovak Republic in the area of veteran care. Legal status of veteran can be bestowed only on a citizen of the Slovak Republic with permanent address in the territory of the Slovak Republic who complies with other conditions provided by this Act

Act No. 726/2004 Coll. on the Provision of a One-Off Financial Contribution to Persons Sent to Military Forced Labour Camps between 1948 and 1954 and to Surviving Spouses of These Persons

Amendments: Act no. 612/2005 Coll. (with effect from 30th december 2005)

The relevant Act regulates conditions for the provision of a one-off financial contribution to persons sent to military camps of forced labour between 1948 and 1954 and to surviving spouses of these persons.
The contribution shall be claimed on the basis of written request for the provision of contribution placed with the Ministry of Defence of the Slovak Republic by 30th June 2006, at the latest; otherwise such claim shall lapse.


Act No. 255/1946 Coll. on Members of the Czechoslovak Army Abroad and on Certain Other Participants in the National Resistance Movement

Amendments: Act No. 101/1964 Coll. (with effect from 1st July 1964)

 

The Act regulates status of participants in the national resistance movement and exercise of their preferential rights arising from such status.

Act No. 541/2005 Coll. on the Transformation of Certain State Enterprises into Joint-Stock Companies
This Act lays down conditions for the transformation of Vojenský opravárenský podnik 015 Nováky (Military Repairs), state enterprise; Vojenský opravárenský podnik 027 Trenčín (Military Repairs), state enterprise; Letecké opravovne Trenčín (Aircraft Repairs), state enterprise; and LOBB, state enterprise, Banská Bystrica into joint-stock companies with 100% state participation.

Act No. 172/2004 Coll. on the Transfer of Real Estates Owned by the Slovak Republic to Municipalities or Higher Territorial Units
Amendments: Act No. 657/2005 Coll. (with effect from 30th December 2005)

 

The relevant Act provides conditions and procedure for the assignment of real estates owned by the Slovak Republic administered by the Ministry of Defence of the Slovak Republic or administered by a higher military administration, which became surplus for the Ministry of Defence of the Slovak Republic and the higher military administration, to municipalities or higher territorial units.
Assignment of ownership to assets owned by the state may concern
a) military constructions;
b) lands creating one working whole with military constructions;

c) other lands with the exception of forest property of the state and lands which create or belong to the agricultural land fund.
